1. Services Provided We offer AI-powered automation, call handling, and lead generation tools for home service businesses. Our services are designed to streamline customer communication, improve scheduling, and enhance business operations.

2. Eligibility You must be at least 18 years old and capable of entering into a binding agreement to use our services.

3. Use of Services You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for any content you provide, including customer data, service descriptions, or any business-specific configurations.

4. Subscription and Payment All services are billed on a month-to-month basis. There is no long-term contract. You may cancel at any time, and service will continue until the end of the current billing period. All payments are processed through Stripe or Whop. In some cases, we may collect payment information directly from you (e.g., during a Zoom call) before securely entering it into Stripe or Whop. While we do not store payment information long-term, we handle it responsibly and protect it using appropriate security practices. We will never share or misuse your payment data.

5. Cancellations and Refunds You may cancel your subscription at any time without penalty. Cancellations must be made before your next billing date to avoid charges for the following month. All sales are final. Due to the nature of our digital services, automations, and time invested in setup and strategy, Better Estimates does not offer refunds under any circumstances. By purchasing, you acknowledge and agree that all payments are non-refundable, and you are responsible for all charges incurred.

6. Intellectual Property All materials, branding, scripts, workflows, and content we provide or develop remain our intellectual property unless otherwise agreed in writing. You may not copy, modify, distribute, or resell our materials without our permission.

- All terms must be documented in writing and mutually agreed upon via email or signed proposal.

- Any verbal agreements made during recorded Zoom calls will be considered binding if both parties express mutual consent.

- Better Estimates reserves the right to discontinue work or revoke access at any time if the other party breaches the terms, misrepresents expectations, or becomes unresponsive.

- The non-refundable nature of Better Estimates services still applies to all custom arrangements unless otherwise explicitly stated.

- In one-time custom arrangements, the client understands and agrees that Better Estimates is not entering into an ongoing services contract or joint venture. Unless otherwise agreed in writing, Better Estimates is not obligated to provide long-term maintenance, support, or revenue participation beyond the scope defined in the original agreement.

- Better Estimates retains full ownership and administrative control of all software systems, AI workflows, and platforms unless explicitly transferred in writing. Access may be revoked if misuse, abuse, or breach of agreement occurs.

10. Modifications We may update these Terms occasionally. If we make material changes, we will notify you via email or through our platform. Your continued use of the services after any updates indicates your agreement to the revised Terms.

11. Scope of Work & Boundaries All deliverables, responsibilities, and communication expectations for custom engagements must be clearly defined before work begins. Better Estimates is not responsible for business results, customer outcomes, or external integrations beyond the agreed scope. Ongoing support, iterations, or additional services may be subject to additional fees.

12. Termination We reserve the right to suspend or terminate your access to the services if you violate these Terms or misuse the platform. You may also terminate your subscription at any time with no penalty.

13. Governing Law These Terms are governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law principles.
